Philly DA Sues Elon Musk, America PAC Over $1M Sweepstakes: Court Documents

The Philadelphia District Attorney's Office is suing Elon Musk and his America PAC over the $1 million sweepstakes both parties have been running at town halls in Pennsylvania.

Musk and America PAC "are running an illegal lottery in Philadelphia (as well as throughout Pennsylvania)," the lawsuit states. The court document was posted online by CNN on Monday, Oct. 28.

“The Philadelphia District Attorney is charged with protecting the public from public nuisances and unfair trade practices, including illegal lotteries," the Philadelphia District Attorney's Office said in a Monday, Oct. 28 news release. "The DA is also charged with protecting the public from interference with the integrity of elections."

The lawsuit points to statements made at an Oct. 19, 2024 rally; on a post on X, formerly Twitter; and on a post on the America PAC website as the beginning of the "scheme." 

"They announced that if a registered voter turns over their personal identifying information (i.e., address, cell phone number and e-mail address) and makes a political pledge by signing a petition pledging support for “the Constitution, especially freedom of speech and the right to bear arms”; they are eligible to be selected “randomly” win $1 million," the lawsuit states.

That entire process constitutes an illegal lottery, according to the lawsuit. 

What makes it illegal is that according to "unambiguous" Pennsylvania law, all lotteries in the state must be regulated by state government, meaning that this enough to warrant an injunction, the lawsuit states. 

Additionally, the state's consumer protection laws are also being violated because the selected winners, who are supposed to be random, are "individuals who have shown up at Trump rallies in Pennsylvania," according to the lawsuit.

There were a total of three $1 million winners of the America PAC sweepstakes in Pennsylvania, according to previous reporting by Daily Voice
